About these terms

These terms apply to the AL HAYBA online store at alhayba.info, also branded Alhayba.co. References to “we”, “us” and “our” mean AL HAYBA. Our store is powered by Shopify. Please read these terms together with our Returns and Refunds Policy, Shipping Policy and Privacy Policy.

Consumer rights come first

Nothing in these terms or our other policies excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law. If a term conflicts with such a right, the right takes priority.

Products must meet applicable consumer guarantees, including acceptable quality and conformity with their description. Remedies for a failure depend on the circumstances and may include repair, replacement, refund or compensation. Our Returns and Refunds Policy explains how to contact us.

Using the store and your account

You must have the legal capacity and authority to make a purchase. If you are under the age required to enter a binding contract where you live, a parent or guardian must make the purchase for you. Provide accurate, current billing, delivery and contact information and use only payment methods you are authorised to use.

Keep account login details secure and contact us if you suspect unauthorised access. You must not misuse the store, attempt to bypass its security, introduce malicious software, impersonate another person, collect others' personal information unlawfully or infringe another person's rights.

Product information and sizing

We aim to describe and photograph our products accurately. Screens and lighting can cause minor differences in the appearance of colours. Please check the relevant size guide and product description before ordering. These explanations do not excuse a product that is materially different from its description, sample or agreed specifications.

Product information and availability may change for future purchases. Changes made after you order do not retrospectively change the description or terms on which you purchased.

Orders and availability

Submitting an order is an offer to buy the listed items. We will communicate order acceptance and dispatch information by email. An automated payment or order-receipt message does not, by itself, confirm dispatch.

We may decline or cancel an order for a genuine reason, such as an item being unavailable, an apparent pricing error, a payment failure or a reasonable fraud concern. We will tell you promptly and refund any payment for goods we cannot supply. We will not substitute items or increase the amount charged without your agreement.

Purchases are intended for personal or household use. Contact us before ordering for commercial resale.

Prices, payment and promotions

Prices are shown in the currency displayed on the store and at checkout. Prices advertised to Australian consumers include any applicable GST. Delivery charges and any other applicable charges are disclosed before you complete payment. International import duties or taxes that are not collected at checkout are explained in our Shipping Policy.

The price and any promotion accepted for your order are shown in the order confirmation. Later price changes do not alter an existing order. Where there is a genuine pricing error, we will contact you to discuss the available options, including cancellation and a refund; we will not automatically charge a higher price.

Promotion conditions, including eligibility and expiry dates, apply as disclosed with the offer. Bundle contents and the applicable size selection are described on each bundle product page. Bundle savings, where displayed, compare the bundle price with the current individual prices of the included products. Promotions do not remove consumer guarantees.

If you choose a third-party payment service, its payment terms also apply. They do not remove your rights against us for the products we supply.

Shipping and delivery

Delivery options, preparation times and estimated delivery times are set out in our Shipping Policy. Delivery estimates may be affected by factors outside our control, but we remain responsible for meeting our obligations to you. Risk of loss is not automatically transferred to you simply because we hand an order to a carrier.

Contact sales@alhayba.info if a parcel is missing, damaged or incorrect, or if you need help with a delay.

Cancellations, returns and refunds

You may cancel within 2 working days of placing an order if it has not been dispatched. Contact us immediately with the order number. This is separate from any cancellation right required by law.

We do not provide a general change-of-mind return or exchange entitlement after delivery. Faulty, incorrect or misdescribed goods are handled under our Returns and Refunds Policy and applicable law. Neither sale pricing nor purchase as part of a bundle removes those rights.

Intellectual property and reviews

Our branding, product imagery, website content and designs are owned by us or used with permission and are protected by applicable intellectual property laws. You may browse the store and use its content for your personal shopping needs. Do not reproduce or commercially exploit protected content without permission or another lawful basis.

Reviews and other content you submit must be honest, lawful and based on your own experience. Do not include another person's confidential information or material you are not entitled to share. By submitting a review for publication, you permit us and our review service provider to display it in connection with the store and its products. Any separate use of private customer correspondence or customer photographs for marketing requires appropriate permission.

We may moderate unlawful, abusive, fraudulent or irrelevant submissions. We will not alter a review to misrepresent the reviewer's opinion.

Shopify and other third-party services

Shopify provides the technology that hosts our store. Your contract to purchase our products is with AL HAYBA, not Shopify. This does not exclude any responsibility that a party has under applicable law.

The store may include third-party tools, payment services, social features or links. Their own terms and privacy notices apply to their services. We do not control unrelated third-party websites, but this does not remove our responsibility for our own conduct or the goods we sell.

Privacy and communications

Our Privacy Policy explains how personal information is handled, including by Shopify and service providers. Shopify's own information is available in its Privacy Policy.

Placing an order does not automatically subscribe you to email or SMS marketing. Marketing communications are subject to applicable consent requirements and include an unsubscribe method. Essential order and service messages may still be sent after you unsubscribe from marketing.

Website access and responsibility

We take reasonable care in operating the store, but access may be interrupted for maintenance, technical issues or circumstances outside our control. Contact us if a technical issue affects an order or payment.

We may restrict access where reasonably necessary to address fraud, unlawful conduct, security threats or a material breach of these terms. We will provide notice where reasonably practicable. This does not remove any entitlement relating to orders already paid for.

Responsibility for loss is determined under applicable law. We do not exclude liability for fraud, our failure to meet non-excludable obligations, or any other liability that cannot lawfully be excluded. You are not required to indemnify us for loss caused by our own acts or omissions merely because you use this website.

Changes and governing law

We may update these terms for future use of the store. The version applying when an order is placed governs that order unless we agree otherwise with you or a change is required by law. Material changes will be notified where required.

Australian law applies, subject to any mandatory consumer protections that apply where you live. Nothing in these terms prevents you from accessing a court, tribunal or regulator with lawful jurisdiction. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law.
